Terms & Conditions

§ 1 Scope

These Terms and Conditions apply to all contracts between CupCycle GmbH, Max-Planck-Straße 35, Halle 7, 50858 Köln (hereinafter "CupCycle") and the customer regarding the rental, sale, and cleaning of reusable cups and related services.

§ 2 Contract Conclusion

Offers from CupCycle are non-binding. A contract is only concluded through written order confirmation by CupCycle.

§ 3 Prices and Payment

All prices are exclusive of statutory VAT. Invoices are payable within 14 days of the invoice date without deduction. In case of late payment, statutory regulations apply.

§ 4 Rental Conditions

Rented cups remain the property of CupCycle. The customer is obligated to handle the cups with care and return them in full after the rental period. Damaged or missing cups will be charged to the customer.

§ 5 Liability

CupCycle is only liable for damages caused by intentional or grossly negligent behavior. Liability for slight negligence is excluded unless essential contractual obligations are breached.

§ 6 Cancellation

Cancellation of a confirmed order may incur cancellation fees. The amount depends on the timing of cancellation and the work already performed.

§ 7 Final Provisions

German law applies. Place of jurisdiction is Cologne, if the customer is a merchant or a legal entity under public law. Should individual provisions of these terms be invalid, the validity of the remaining provisions shall remain unaffected.
